Terms of Service — Pocket Lead

Acceptance of Terms

By downloading, installing, or using Pocket Lead, you agree to be bound by these Terms of Service. This agreement is concluded between you and Alexander Spurlock only, and not with Apple, Inc. If you do not agree, do not use the app.

Age Requirement

You must be at least 16 years old to use Pocket Lead. By using the app, you confirm that you meet this requirement.

License Grant

Subject to your compliance with these Terms, Alexander Spurlock grants you a limited, non-transferable license to use Pocket Lead on any Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. This license may be extended to other accounts associated with you via Family Sharing or volume purchasing as permitted by Apple.

What Pocket Lead Is

Pocket Lead is a lead management tool designed for contractors and service professionals. It helps you track leads, log activity, and draft follow-up messages. AI-generated messages are suggestions only — they are a starting point for your communication, not a finished product.

AI-Generated Content

Messages generated by AI are not guaranteed to be accurate, appropriate, or suitable for any particular customer or situation. You are solely responsible for reviewing every AI-generated message and deciding whether and how to send it.

Alexander Spurlock is not liable for the content of AI-generated messages or for any outcome resulting from messages you choose to send to your customers.

Your Account

You are responsible for maintaining the security of your account credentials. Do not share your account with others. Each user is permitted one account. You are responsible for all activity that occurs under your account.

Subscription and Billing

Free plan

The free tier includes up to 10 AI-generated messages per day.

Pro plan

Monthly: $14.99 / month
Annual: $129.99 / year
Includes up to 200 AI-generated messages per day

Billing and cancellation

Subscriptions are billed and managed through the Apple App Store or Google Play, depending on where you downloaded the app. Cancellation, billing disputes, and refund requests are handled directly by Apple or Google under their respective policies. We do not process payments directly and cannot issue refunds.

Your subscription auto-renews unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device's account settings at any time.

Data after cancellation

Your lead data is retained after your subscription ends. You can continue to access your data on the free plan and delete your account at any time from within the app.

Your Data

You own the lead data you enter into Pocket Lead. By storing your customers' contact information in the app, you represent that you have the right to do so — whether through consent, an existing business relationship, or another lawful basis. Alexander Spurlock does not claim ownership of your data.

Prohibited Uses

You may not use Pocket Lead to:

Violate any applicable laws or regulations
Store or process data about individuals without a lawful basis to do so
Abuse or attempt to circumvent limits on AI message generation
Use automated tools or scripts to access or scrape the app or its data
Harass, threaten, or harm any individual

Legal Compliance

By using Pocket Lead, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms

Pocket Lead uses third-party services. By using the app, you agree to comply with the applicable terms of service for each:

Google Terms of Service — Firebase authentication, database storage, and Gemini AI
RevenueCat Terms of Service — subscription management
Apple's Media Services Terms and Conditions — App Store billing

Termination

Alexander Spurlock reserves the right to suspend or terminate accounts that violate these Terms or abuse the service. If your account is terminated for cause, you are not entitled to a refund of any prepaid fees.

Maintenance and Support

Alexander Spurlock is solely responsible for providing maintenance and support services for Pocket Lead. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Pocket Lead.

Warranty

Pocket Lead is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. Alexander Spurlock is solely responsible for any product warranties, to the extent not effectively disclaimed here.

In the event that Pocket Lead fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to Pocket Lead. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are Alexander Spurlock's sole responsibility.

Product Claims

You acknowledge that Alexander Spurlock, not Apple, is responsible for addressing any claims by you or any third party relating to Pocket Lead or your use of it, including: (i) product liability claims; (ii) any claim that Pocket Lead fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property

In the event of any third-party claim that Pocket Lead or your possession and use of it infringes that third party's intellectual property rights, Alexander Spurlock, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Limitation of Liability

To the maximum extent permitted by applicable law, Alexander Spurlock is not liable for any indirect, incidental, special, or consequential damages arising from your use of Pocket Lead, including but not limited to missed follow-ups, lost business opportunities, or the content of messages sent to your customers.

Apple App Store

You acknowledge and agree that:

This agreement is between you and Alexander Spurlock only, not Apple. Alexander Spurlock, not Apple, is solely responsible for Pocket Lead and its content.
Alexander Spurlock, not Apple, is solely responsible for providing maintenance and support for Pocket Lead.
Apple has no warranty obligation with respect to Pocket Lead, beyond the refund right described in the Warranty section above.
Alexander Spurlock, not Apple, is responsible for addressing any end-user or third-party claims relating to Pocket Lead.
Apple, Inc. and its subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of Pocket Lead after changes are posted constitutes your acceptance of the updated Terms.
